Terms and Conditions

1. Scope

These terms and conditions (T&Cs) apply to all contracts for the sale and delivery of goods by Haus of Namaste, owned by Tanya Tripathi, based in Nürnberg, Germany, to consumers and businesses (hereinafter referred to as "Customer" or "you"). By placing an order, you agree to these T&Cs.

2. Contract Conclusion

The presentation of products on our website does not constitute a legally binding offer but an invitation to place an order. By clicking the "Order" button, you make a binding offer to purchase the goods in your shopping cart. We will confirm receipt of your order immediately by email. A binding contract is formed only when we send an order confirmation or dispatch the goods.

3. Right of Withdrawal

3.1 Consumers' Right of Withdrawal

Consumers (any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession) have a statutory right to withdraw from this contract within fourteen days without giving any reason.

The goods should be returned in the original state , without damage and incase of clothing , the items should be returned unworn , unwashed and undamaged condition.

3.2 Withdrawal Period

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, takes possession of the goods.

3.3 Exercising the Right of Withdrawal

To exercise your right of withdrawal, you must inform us Haus of Namaste,  Email: Hello@hausofnamaste.com of your decision to withdraw from this contract by an unequivocal statement (preferably email or via Post). You may use the attached model withdrawal form, but it is not obligatory.

3.4 Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, excluding delivery costs and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction ; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back and checked the goods for damage.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

4. Prices and Payment

4.1 Prices

All prices are inclusive of the applicable statutory VAT and are exclusive of shipping costs unless stated otherwise.

4.2 Payment Methods

We offer the following payment methods:
- Credit Card (Visa, MasterCard, American Express , Apple Pay , Gpay , Klarna)
- PayPal

5. Delivery

5.1 Delivery Times

Delivery times are specified on our product pages. These times are approximate and subject to the availability of the goods.

5.2 Delivery Costs

Shipping costs are not included in the product prices and will be added during the checkout process.

5.3 Risk Transfer

The risk of loss or damage to the goods passes to the customer upon delivery.

6. Retention of Title

The goods remain our property until full payment has been made. If you are a business, we retain title to all goods delivered by us until all claims arising from the business relationship have been settled in full.

7. Liability for Defects

7.1 Statutory Warranty

We are liable for defects in accordance with statutory provisions. In case of defects, you are entitled to statutory warranty rights.

7.2 Warranty Period

The warranty period for goods supplied by us is two years from the date of delivery.

8. Voucher Redemption

8.1 Conditions

Vouchers can only be redeemed within the specified period and for products listed on our website. Vouchers cannot be exchanged for cash and are not transferable.

8.2 Redemption Process

To redeem a voucher, enter the voucher code during the checkout process. Only one voucher can be used per order.

9. Applicable Law

These terms and conditions and all contracts concluded with us are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

10. Dispute Resolution

We are committed to resolving any disputes amicably. However, we are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
